Submission: PJCIS Mandatory Data Retention Scheme

Allens Hub researchers Dr Monika Zalnieriute and Genna Churches prepared a submission to the Parliamentary Joint Committee on Intelligence and Security Review of the Mandatory Data Retention Scheme. 

The submission made nine recommendations on the mandatory data retention scheme ranging from the general incompatibility of the scheme with the right to privacy, to international jurisprudence protecting sensitive information such as location data; that metadata is 'personal information', to inconsistencies within Telecommunications (Interception and Access) Act 1979 (Cth) such as the potential availability of content such as URLs. 

The researchers urged the committee to consider the implementation of a warrant-based system, similar to a telecommunications interception warrant, to access metadata.
